Shelby County Landfill to Contain Dumped Paint & Sludge

Caldwell Landfill in Shelby County has a pending Draft Hazardous Waste Corrective Action Permit that was placed out for Public Notice dated 7/19/2011.  The filing also includes an Interested Party Letter and a Fact Sheet in Word document form that is pasted below:

The Indiana Department of Environmental Management (IDEM) has prepared this fact sheet to inform the public of the process involved in issuing a corrective action permit to Caldwell Landfill.
The Solid Waste Disposal Act, commonly known as the Resource Conservation and
Recovery Act (RCRA) was passed in 1976. This allowed for the regulation of the
management of hazardous waste. In the State of Indiana, IDEM is authorized by the Indiana Environmental Statutes, IC 13-22, to administer the hazardous waste permit program and related hazardous waste management requirements. Any facility which treats, stores, and/or disposes of hazardous waste in the State of Indiana is required to obtain a final hazardous waste management permit. In addition, any hazardous waste facility receiving a permit is required to provide corrective action for all releases of hazardous waste or of hazardous waste constituents from any solid waste management unit on-site.
Facility Description
From about 1976-1980, special waste consisting primarily of metal hydroxide sludge and paint solids was disposed of in narrow shallow trenches within a four (4) +/- acre parcel of property in the SW quarter of Section 2, T14N, R7E, Shelby County, Indiana. The disposal occurred prior to the effective date of the Federal Subtitle C regulations in 1980. With these 1980 regulations the deposited material became listed waste. This application seeks approval from the Indiana Department of Environmental Management to incorporate this waste into a Corrective Action Management Unit (CAMU). A CAMU is a small landfill that will be used to provide safer disposal for these wastes only.
IDEM’s Role
IDEM staff reviews the permit application; prepares the draft permit, and the public notice; responds to any comments received during the public comment period and issues the final permit decision. The draft permit contains the following items:
Permit Conditions
I. Standard Conditions: These conditions are of a general nature and are required for all facilities that manage hazardous waste under a RCRA permit.
II. General Facility Conditions: These conditions are also general in nature and required for all facilities, but are more specific in determining operating requirements.
III. CAMU Conditions: These conditions are specific to the Corrective Action Management Unit.
IV. Corrective Action Conditions: These conditions provide for the investigation and remediation of any releases from a Solid Waste Management Unit (SWMU) or Area of Concern (AOC). These conditions also require owners and operators to provide information, including sampling, to the IDEM to support whether or not a release has occurred.
V. Groundwater Monitoring Conditions: These are specific regulations the facility must follow that are applicable to a groundwater monitoring plan. Included in this section are well descriptions, placement, and characteristics as well as regulatory provisions for the monitoring plan.
VI. Compliance Schedule Conditions: These conditions specify a compliance schedule leading to compliance with the Indiana Hazardous Waste Rules.
Permit Attachments
Attachment A - Facility Description: This attachment provides general information of the site and surrounding land.
Attachment B – Construction Quality Assurance/Quality Control Plan: Ensures that construction of the unit will follow the approved plan.
Attachment C – Construction Technical Specifications: Detailed specifications for design elements of the unit.
Attachment D – Operational Inspections, Contingency, Training, Leachate Collection and
Leak Detection: These requirements outline procedures for the safe operation of the CAMU.
Attachment E – Closure Plan, Post Closure Inspection Requirements, Post Closure Routine Inspection Form and Post Closure Cost Estimate: The Closure Plan describes, in detail, the activities and procedures that will be carried out to ensure that the corrective action management unit has been closed in accordance with 329 IAC 3.1. This section also describes activities during the post-closure care period to ensure that the site is maintained for at least thirty (30) years. Attachment G – Groundwater Monitoring, Sampling and Analysis Plan, Quality Assurance Project Plan and Statistical Plan: This attachment details the types of monitoring that are implemented by the facility and the way the information is collected. The plan details the following: 1). Development of a list of groundwater indicator parameters and monitoring constituents used to indicate a release from the regulated unit(s). 2). Establishment of sampling and statistical analysis requirements to determine if a release has occurred. 3). Establishment of additional requirements if a statistically significant release occurs.
Attachment H – Facility Map/SWMU Locations: This attachment shows the location of SWMUs at the site.
Public Participation
The public comment period for this corrective action permit began on the date of the public notice, July 19, 2011, and ends on September 2, 2011. The official public notice was published on July 19, 2011, in the Shelbyville News, Shelbyville, Indiana. Written comments with supporting documentation should be mailed to:
